THE COURT ORDERS THAT:
1. The application for leave to file the documents lodged with the Court on 24 August 2026 being:
(a) an application for leave to appeal dated 24 August 2026; and
(b) the supporting affidavit affirmed on 24 August 2026,
is dismissed without an oral hearing.
Note: Entry of orders is dealt with in Rule 39.32 of the Federal Court Rules 2011.
REASONS FOR JUDGMENT
PERRAM J:
1 On 24 August 2026, the applicant lodged the following documents for filing:
(a) an application for leave to appeal from the decision of Jackman J in LFDB v SM (No 9) [2026] FCA 1118; and
(b) an affidavit in support of the application for leave to appeal affirmed on 24 August 2026.
2 Those documents were referred to the filings judge who made a direction pursuant to r 2.27(f) of the Federal Court Rules 2011 (Cth) that the documents were not to be accepted for filing without leave of the Court. The applicant now brings an application for leave pursuant to r 2.27A of the Federal Court Rules 2011 (Cth).
3 I am not satisfied the application for leave to appeal has any prospects of success.
4 Leave to file the documents is refused.
