THE COURT NOTES THAT:
A. The Applicant in proceedings WAD 91 of 2019 has made a native title determination application (“Nyalpa Pirniku Application”).
B. The Applicant in the Nyalpa Pirniku Application, the State of Western Australia and the other Respondents to the Nyalpa Pirniku Application ("the parties") have reached an agreement as to the terms of the determination which is to be made in relation to the land and waters covered by the Nyalpa Pirniku Application (“the Determination Area”). The external boundaries of the Determination Area are described in Schedule 1 to the Determination.
C. Pursuant to subsections 87(1), (1A) and (2) of the Native Title Act 1993 (Cth) ("Native Title Act") the parties have filed with the Court this Minute of Proposed Consent Determination of Native Title setting out the terms of the agreement reached by the parties in relation to the Nyalpa Pirniku Application.
D. The terms of the agreement involve the making of consent orders for a determination pursuant to sections 87 and 94A of the Native Title Act that native title exists in relation to the land and waters of the Determination Area (save for those areas identified in Schedule 4).
E. The parties acknowledge that the effect of the making of the determination is that the members of the native title claim group, in accordance with the traditional laws acknowledged and the traditional customs observed by them, should be recognised as the native title holders for the Determination Area as set out in the determination.
F. Pursuant to section 87(2) of the Native Title Act, the parties have requested that the Court determine the proceedings that relate to the Determination Area without holding a hearing.
G. The Applicant in the Nyalpa Pirniku Application has nominated the Wangkatja Tjungula Aboriginal Corporation (ICN 9951) pursuant to section 57(2)(a) of the Native Title Act to hold the determined native title as agent for the native title holders.
BEING SATISFIED that a determination of native title in the terms set out in Attachment A would be within the power of the Court and, it appearing to the Court appropriate to do so, pursuant to sections 87 and 94A of the Native Title Act and by the consent of the parties:
BY CONSENT THE COURT ORDERS THAT:
1. In relation to the Determination Area, there be a determination of native title in WAD 91 of 2019 in the terms provided for in Attachment A.
2. The Wangkatja Tjungula Aboriginal Corporation (ICN 9951) shall hold the determined native title as agent for the native title holders pursuant to section 57(2) of the Native Title Act 1993 (Cth).
3. There shall be no order as to costs.

ATTACHMENT A
DETERMINATION
THE COURT ORDERS, DECLARES AND DETERMINES THAT:
Existence of native title: section 225 Native Title Act
1. Subject to paragraph 2, native title exists in the Determination Area in the manner set out in paragraphs 4 and 5 of this determination.
2. Native title does not exist in those parts of the Determination Area that are identified in Schedule 4.
Native title holders: section 225(a) Native Title Act
3. The native title in the Determination Area is held by the Native Title Holders.
The nature and extent of native title rights and interests and exclusiveness of native title (sections 225(b) and 225(e) Native Title Act)
Exclusive rights and interests
4. Subject to paragraphs 2, 6 and 10, the nature and extent of the native title rights and interests in relation to the Exclusive Area are the right to possession, occupation, use and enjoyment of the Exclusive Area to the exclusion of all others.
Non-exclusive rights and interests
5. Subject to paragraphs 2, 6, 7 and 10, the nature and extent of the native title rights and interests in relation to the Non-Exclusive Area are that they confer the following non-exclusive rights:
(a) the right to access, remain in and use the Non-Exclusive Area;
(b) the right to access, take and use the resources of the Non-Exclusive Area for any purpose;
(c) the right to engage in spiritual and cultural activities on the Non-Exclusive Area; and
(d) the right to maintain and protect places and objects of significance on the Non-Exclusive Area.
Qualifications on the native title rights and interests
6. Notwithstanding anything in this determination, the native title rights and interests set out in paragraphs 4 and 5:
(a) are subject to and exercisable in accordance with:
(i) the laws of the State and the Commonwealth, including the common law; and
(ii) the traditional laws and customs of the Native Title Holders;
(b) do not confer exclusive rights in relation to water in any watercourse, wetland or underground water source as is defined in the Rights in Water and Irrigation Act 1914 (WA); and
(c) do not confer any rights in relation to:
(i) minerals as defined in the Mining Act 1904 (WA) (repealed) and in the Mining Act 1978 (WA), except to the extent that ochre is not a mineral pursuant to the Mining Act 1904 (WA);
(ii) petroleum as defined in the Petroleum Act 1936 (WA) (repealed) and in the Petroleum and Geothermal Energy Resources Act 1967 (WA);
(iii) geothermal energy resources and geothermal energy as defined in the Petroleum and Geothermal Energy Resources Act 1967 (WA); or
(iv) water lawfully captured by the holders of the Other Interests pursuant to those Other Interests.
7. The native title rights and interests set out in paragraph 5 do not confer:
(a) possession, occupation, use and enjoyment on the Native Title Holders to the exclusion of all others; or
(b) a right to control the access to, or use of, the Non-Exclusive Area or its resources.
Areas to which ss 47, 47A or 47B of the Native Title Act apply
8. Sections 47, 47A and 47B of the Native Title Act apply to disregard any prior extinguishment in relation to those parts of the Determination Area identified in Schedule 5.
Relationship between native title rights and other interests
9. The nature and extent of the Other Interests are described in Schedule 6.
Relationship between native title rights and other interests
10. Except as otherwise provided for by law, the relationship between the native title rights and interests described in paragraphs 4 and 5 and the Other Interests is that:
(a) to the extent that any of the Other Interests are inconsistent with the continued existence, enjoyment or exercise of the native title rights and interests, the native title rights and interests continue to exist in their entirety, but the native title rights and interests have no effect in relation to the Other Interests to the extent of the inconsistency during the currency of the Other Interests; and otherwise,
(b) the existence and exercise of the native title rights and interests do not prevent the doing of any activity required or permitted to be done by or under the Other Interests, and the Other Interests, and the doing of any activity required or permitted to be done by or under the Other Interests, prevail over the native title rights and interests and any exercise of the native title rights and interests but do not extinguish them.
Definitions and Interpretation
11. In this determination, unless the contrary intention appears:
“Determination Area” means the land and waters described in Schedule 1 and depicted on the maps at Schedule 2;
“Exclusive Area” means those lands and waters of the Determination Area described in Schedule 3 (which areas are generally shown as shaded green on the maps in Schedule 2);
“Native Title Holders” means the people described in Schedule 7 and referred to in paragraph 3;
“Native Title Act” means the Native Title Act 1993 (Cth);
“Non-Exclusive Area” means those lands and waters of the Determination Area which are not Exclusive Areas or described in paragraph 2 as an area where native title does not exist (which areas are generally shown as shaded yellow on the maps at Schedule 2);
“Other Interests” means the legal or equitable estates or interests and other rights in relation to the Determination Area described in Schedule 6 and referred to in paragraph 9;
“resources” means flora, fauna, and other natural resources such as charcoal, stone, soil, sand, clay, gravel, timber, resin and ochre (except, for the avoidance of doubt, ochres for use in the manufacture of porcelain, fine pottery or pigments which are minerals pursuant to the Mining Act 1904 (WA) (repealed)); and
“Titles Validation Act” means the Titles (Validation) and Native Title (Effect of Past Acts) Act 1995 (WA).
12. In the event of any inconsistency between the written description of an area in Schedule 1, Schedule 3, Schedule 4, Schedule 5 or Schedule 6 and the area as depicted on the maps at Schedule 2 the written description prevails.

7. Access to Mining Tenements and Petroleum Interests
(a) Without limiting the operation of any other clause in this Schedule 6, but subject to clause 7(b) below, any rights of the holders from time to time of a mining tenement or petroleum interest, including those listed in clauses 5 and 6 of this Schedule 6, to use (including by servants, agents and contractors) such portions of roads and tracks in the Determination Area (existing as at the date of this determination) as are necessary to have access to the area the subject of the mining tenement or petroleum interest for the purposes of exercising the rights granted by that tenement or interest.
(b) Nothing in clause 7(a) above allows any upgrade, extension, widening or other improvement to the road or track other than work done to maintain it in reasonable repair and in order to leave it in substantially the same condition as it was prior to its use pursuant to clause 7(a).
(c) Nothing in this Schedule 6 will limit the rights of the holders from time to time of mining tenements or petroleum interests (including those listed in clauses 5 and 6 of this Schedule 6), including any existing right to exclude members of the public from entering onto the land and waters the subject of any mining tenement or petroleum interest.
8. Telstra Corporation Limited
The rights and interests of Telstra Corporation Limited (ACN 051 775 556), Amplitel Pty Ltd as trustee of the Towers Business Operating Trust (ABN 75 357 171 746) and any of their related bodies corporate and successors in title:
(a) as the owners or operators of telecommunications facilities within the Determination Area;
(b) created pursuant to the Post and Telegraph Act 1901 (Cth), the Telecommunications Act 1975 (Cth), the Australian Telecommunications Corporation Act 1989 (Cth), the Telecommunications Act 1991 (Cth) and the Telecommunications Act 1997 (Cth), including rights:
(i) to inspect land;
(ii) to install, occupy and operate telecommunications facilities; and
(iii) to alter, remove, replace, maintain, repair and ensure the proper functioning of their telecommunications facilities;
(c) for their employees, agents or contractors to access their telecommunications facilities in and in the vicinity of the Determination Area in the performance of their duties; and
(d) under any lease, licence, permit, access agreement or easement relating to their telecommunications facilities in the Determination Area.
9. Other
The following rights and interests in the Determination Area:
(a) Rights and interests, including licences and permits, granted by the Crown in right of the State or of the Commonwealth pursuant to statute or otherwise in the exercise of its executive power and any regulations made pursuant to such statutes;
(b) Rights and interests held by reason of the force and operation of the laws of the State or of the Commonwealth including the Rights in Water and Irrigation Act 1914 (WA);
(c) Rights and interests of members of the public arising under the common law, including but not limited to:
(i) the public right to fish;
(ii) the public right to navigate; and
(iii) the right of any person to use and enjoy any roads in the Determination Area (subject to the laws of the State) over which, as at the date of this determination, members of the public have a right of access under the common law;
(d) The right to access the Determination Area by:
(i) an employee, agent or instrumentality of the State;
(ii) an employee, agent or instrumentality of the Commonwealth; or
(iii) an employee, agent or instrumentality of any local government authority,
as required in the performance of his or her statutory or common law duty, including for the purpose of pest management control and fire hazard management on areas of unallocated Crown land;
(e) So far as confirmed pursuant to section 212(2) of the Native Title Act and section 14 of the Titles Validation Act as at the date of this determination, any existing public access to and enjoyment of:
(i) waterways;
(ii) beds and banks or foreshores of waterways;
(iii) coastal waters;
(iv) beaches;
(v) stock routes; and
(vi) areas that were public places at the end of 31 December 1993;
(f) Any other:
(i) legal or equitable estate or interest in the land or waters of the Determination Area; or
(ii) right (including a right under an option and a right of redemption), charge, power or privilege over, or in connection with:
A. the land or waters of the Determination Area; or
B. an estate or interest in the land or waters of the Determination Area; or
(iii) restriction on the use of the land or waters of the Determination Area, whether or not annexed to other land or waters.

INTRODUCTION
1 These reasons concern the consent determination of native title pursuant to s 87 of the Native Title Act 1993 (Cth) (NTA) over the lands and waters covered by the Nyalpa Pirniku Amended Application filed on 21 September 2021. A Consent Minute of proposed determination was filed on 26 September 2023.
2 This Application covers an area of approximately 30,884 square kilometres and is in the eastern Goldfields region of Western Australia. It encompasses three local government regions, a number of towns, the Aboriginal community of Mt Margaret, current and former pastoral stations, reserves, roads and Crown lands and a series of salt lakes and a number of developed mines (the Determination Area).
3 Through careful and co-operative case management, the parties have reached agreement as to the existence of native title and the nature and extent of the native title rights and interests over the Determination Area. The Nyalpa Pirniku Applicants and the first respondent, the State of Western Australia, have provided written joint submissions in support of the Consent Minute. Much of what follows is drawn from the joint submissions. Where, for convenience, I refer within to “the parties” making joint submissions, I am referring to the Nyalpa Pirniku Applicants and the State.
BACKGROUND
4 The Nyalpa Pirniku Applicants initiated their Original Application in February of 2019 pursuant to s 61 of the NTA on behalf of the Nyalpa Pirniku claim group. The Nyalpa Pirniku Applicants, represents a group of authorised applicants, some of whom have since passed. They are Patricia Lewis, Leo Thomas, Vanessa Thomas, Ron Harrington-Smith, H.O (deceased), Darren Polak, E.S (deceased), Aubrey Lynch, John Walter Danny Graham and Timothy Sceghi.
5 The Nyalpa Pirniku Applicants bring the Application on behalf of members of the Western Desert Cultural Bloc (WDCB). They refer to themselves as Wangkayi, which is also the name of their language. In Wangkayi, “Nyalpa Pirniku” refers to the “old people” or elders in the community. The name was chosen by the Nyalpa Pirniku Applicants in recognition of their elders. Generally, Wangkayi refers to Western Desert people associated with the south-western part of the Western Desert.
6 As at the date of the filing of the joint submissions, the respondents comprised of the following parties:

PROCEDURAL HISTORY
7 The Original Application was entered onto the Register of Native Title Claims on 15 May 2019. The period after the notification, referred to in s 66 of the NTA, ended on 27 November 2019.
Overlap with other claims pending at the time of registration
8 The Original Application overlapped with the claimed area in two other applications — the Darlot Application and the Maduwongga Application.
9 The overlap between the Original Application and the Darlot Application was resolved following a mediation. On 9 December 2020, the boundary of the Darlot Application was amended eliminating the overlap. The Original Application was amended, in the form of the Application, to include the descendants of “siblings – Sarah Brown and Jack Merrick (children of Bindinni)”, who were otherwise members of the Darlot Application.
10 The overlap between this Application and the Maduwongga Application resolved following determination by the Court of a separate question on 27 March 2023: Strickland on behalf of the Maduwongga Claim Group v State of Western Australia [2023] FCA 270. The question posed for separate determination was:
“Did [KB, the paternal grandmother of the Maduwongga Applicants]…hold rights and interests in those land and waters of the Maduwongga application which overlap with native title determination application [Nyalpa Pirniku] under the normative system of traditional laws and customs of:
(1) the Western Desert; or
(2) a distinct land-holding group of which KB’s descendants are the only identifiable surviving members?”
11 The particular formulation of the separate question arose because the Maduwongga applicant alleged that the relevant “socio-linguistic community” and “society” (of which KB and her descendants were the only members) was a “Maduwongga” society. The Maduwongga applicant claimed that KB and her descendants alone held and hold native title rights and interests in the area of overlap between the two claims (the Maduwongga Overlap Area). Further, that those rights were held under the normative system of laws and customs of this Maduwongga society. The Maduwongga applicant also said that this Maduwongga society had a “distinctly different system of laws and customs” to the “neighbouring” normative system of traditional laws and customs of what has been described by anthropologists as the WDCB. The Maduwongga applicant denied that KB was a member of the WDCB and/or that she acknowledged and observed the traditional laws and customs of the WDCB.
12 The Nyalpa Pirniku Applicants and the State contended that KB was a member of the WDCB, who acknowledged and observed traditional laws and customs of the WDCB and was just one of a number of persons who held native title rights and interests in the Maduwongga Overlap Area pursuant to the normative system of traditional laws and customs shared by members of the WDCB. On that basis, both the Nyalpa Pirniku Applicants and the State contended that KB (and her descendants) should properly be members of the Nyalpa Pirniku claim group by reason of her (and their) satisfaction of one or more of a criteria of claim group membership in the present Application.
13 The Court found that KB held rights and interests in the Maduwongga Overlap Area under the traditional laws and customs of the WDCB and not as part of a Maduwongga society. The Maduwongga Application was subsequently dismissed.
14 In this Application, the parties have had the benefit of the evidence and findings in the Maduwongga separate question proceeding, in reaching the agreement reflected in the Consent Minute.
The native title holders
15 Schedule A of this Application provides that the application is brought on behalf of:
those Aboriginal people who are recognised under traditional law and custom as having rights in some or all of the Claim Area on one or more of the following bases:
(a) Biological and/or socially recognised descent from one or more of the owners, under traditional law and custom, of some or all of the Claim Area at the time of non-Aboriginal settlement;
(b) their own or an ancestor’s birth on the Claim Area;
(c) their own or an ancestor’s long association with the Claim Area; or
(d) the holding of religious, sacred or ritual authority under traditional law and custom for one or more places on the Claim Area.
The Application also lists 34 apical ancestors (or apical ancestor sets) who are recognised under traditional law and custom as having rights under categories (a) or (b) above.
16 During the course of negotiations, the parties settled on the description of native title holders in Schedule 7 of the Consent Minute. This description differs slightly from that contained in Schedule A of the Application, in that it reformulates two of the apical ancestors sets and adds five additional apical ancestors, including KB (as a consequence of the Maduwongga separate question determination in Strickland).
17 These additional apical ancestors were identified by Native Title Services Goldfields (NTSG), the solicitors for the Nyalpa Pirniku Applicants, as a result of a number of queries made to them by potential claimants who considered that they were not, or were not inadequately, covered by the list of apical ancestors in the Nyalpa Pirniku Form 1. Dr Morton researched the additional apicals and produced a report in relation to them (the Additional Apical Report). The current claim group was then asked to consider the conclusions of this research and assessment on a number of occasions, culminating in meetings on 21 September 2022 and 26 October 2022 in which the additional apical ancestors were endorsed and finally authorised by the claim group.
18 The Nyalpa Pirniku Applicants and the State ultimately settled on the description of the native title holders contained in Schedule 7 of the Consent Minute, having satisfied themselves that the description reflects the position described in the connection materials (principally, the Additional Apical Report and the Court's findings in Strickland). They have agreed that as presently framed Schedule 7 covers all of the relevant native title holders.
RELATIONSHIP WITH WONGATHA DETERMINATION AREA
19 The Determination Area is almost entirely within the Wongatha area which was the subject of the Wongatha Application (WAD6005/1998). The relevant “society” which gives rise to the traditional laws and customs of the Nyalpa Pirniku claimants is that of the WDCB. ‘Western Desert’ or WDCB is used to refer to both an area and to the people who inhabit it. I use “society” to mean the “body of persons united in and by its acknowledgment and observance of a body of law and custom” in the sense explained by the majority of the High Court Members of the Yorta Yorta Aboriginal Community v State of Victoria [2002] HCA 58; 214 CLR 422 at [49]. WDCB is an anthropological description given to the Aboriginal people who inhabit a vast arid area straddling the borders of WA, SA and the NT and who share a relatively homogenous set of laws and customs and mutually intelligible dialects. In this respect, I note, however, the observations of Mortimer J, in Narrier v State of Western Australia [2016] FCA 1519 at [385] to [388].
20 The Wongatha Application was determined in Harrington-Smith v Western Australia (No.9) [2007] FCA 31; 238 ALR 1 (Wongatha Determination). The Wongatha Determination followed a hearing which took place between 2002 and 2004. That hearing involved the Wongatha Application and seven overlapping native title claims that were heard together. The hearing lasted 100 days. A total of 149 witnesses gave evidence. At the hearing, 34 expert anthropological, linguistic and historical reports from 14 experts were considered. The reasons for judgment extend to 4010 paragraphs, together with a summary of Aboriginal evidence contained in Annexure F of the judgment (which extends to a further 7388 paragraphs). The Court delivered judgment on 5 February 2007.
21 Although it is a question of fact and evidence in each case, this Court has in findings or in dicta in a number of cases addressed the boundary of the WDCB, see for example, Wongatha Determination at [540] – [702]; and Narrier at [383] – [384], [499], [512] – [513], [754] – [755], [772] – [775], [780] – [782] and [800].
22 The parties have had the benefit of having regard to a significant amount of material from the Wongatha hearing in formulating their position in respect of this Application and ultimately in reaching agreement in relation to the consent determination which is before the Court.
APPLICABLE LEGAL PRINCIPLES
Power
23 Where, as here, the parties have agreed to the terms of a determination of native title recorded in an agreement pursuant to s 87 of the NTA, the Court has a discretion to make an order in those terms without holding a hearing if the conditions in s 87(1)(a)-(c) of the NTA are met and if it appears to the Court to be appropriate to do so: s 87(1A)-(2).
24 Section 87(1A) was introduced into the NTA by the Native Title Amendment Act 2009 (Cth) in 2009, the requirement that the Court must consider it appropriate to make the determination sought by the parties was previously contained in s 87(1). Given the identical wording of s 87(1A) and the previous iteration of s 87(1) in respect of this requirement, the exercise of the Court’s discretion pursuant to s 87(1A) is informed by the same principles as applied to the making of a consent determination under the previous iteration of s 87(1).
25 As Robertson J observed in Mooney on behalf of the Yuwibara People and State of Queensland [2020] FCA 170 at [10]:
10. When a native title claim is resolved by consent, the applicant does not have to prove their case at a hearing. If an agreement between the parties to a determination is reached, the Court may, if satisfied that an order consistent with the terms of the agreement would be within the power of the Court and it appears appropriate, make a native title determination over the whole or part of a claim area without a hearing. The focus is on whether there is an agreement between parties that was “freely entered into on an informed basis”: Lovett v Victoria [2007] FCA 474 at [37] per North J, citing Nagkiriny v Western Australia [2002] FCA 660; 117 FCR 6 and Ward v Western Australia [2006] FCA 1848. In relation to the State, the Court should be assured that such a party has “taken steps to satisfy itself that there is a credible basis for an application”, or is “satisfied as to the cogency of the evidence upon which applicants rely”: Lovett at [37]; Munn v Queensland [2001] FCA 1229; 115 FCR 109 at [29] per Emmett J.
26 The Court's function, and the nature of its discretion, when considering whether it is “appropriate” to make orders under section 87 of the NTA was considered in detail by Mortimer J, in Freddie v Northern Territory [2017] FCA 867 at [12] – [24] and again in Agius v South Australia (No 6) [2018] FCA 358 at [56] – [77]. In those cases, Mortimer J noted that the Court's function under section 87 of the NTA was “quite different from its function in a contested application for a determination of native title” (Freddie at [16], Agius at [62]). That difference has been repeatedly confirmed: see for example, Lovett on behalf of the Gunditjmara People v State of Victoria [2007] FCA 474 at [36] (North J); Thudgari People v State of Western Australia [2009] FCA 1334 at [25] (Barker J); Goonack v State of Western Australia [2011] FCA 516 at [25] – [26] (Gilmour J) and in relation to s 87A; Wurrunmurra on behalf of the Bunuba People v State of Western Australia [2015] FCA 1480 at [27] (Barker J). In particular, Mortimer J observed that the Court's focus under s 87 of the NTA is on the making of an agreement by the parties and must be understood in the context of the NTA's “emphasis on negotiation and alternative dispute resolution, whereby one particular object of the [NTA] is to resolve claims to native title without judicial determination in a contested proceeding”: Freddie at [17]; Agius at [63].
27 In addition, the exercise of the Court's power under s 87 of the NTA occurs not only in the context of the NTA but also in the context of the Court’s jurisdiction as a whole. In exercising the discretion under section 87 of the NTA, the Court is concerned with promoting the overarching objectives stipulated by ss 37M and 37N of the Federal Court of Australia Act 1976 (Cth) (FCA Act) namely the “just resolution of disputes, according to law, and as quickly, inexpensively and efficiently as possible” (Freddie at [17]; Agius at [66]).
28 Whilst the discretionary evaluation as to the “appropriateness” of orders sought under s 87 of the NTA is wide, satisfaction of the “appropriateness” of those orders must take into account the character and nature of the enduring native title rights sought to be recognised (which will have operation against the whole world and not just as between the parties to the proceeding). As noted by Colvin J in Hobbs on behalf of the Ngurrara D2 Claim Group v Western Australia [2020] FCA 624 at [24]:
24. … there is a broader public interest in the determination because it may affect third parties who do not presently have an interest in the area and may have unforeseen consequences well into the future. It is also has an intergenerational character.
29 Accordingly, in order to be satisfied as to the “appropriateness” of the orders sought, the Court must be satisfied that:
(1) the determination is clear in its terms including as to the determination area, the identity of the native title holders, the nature of the native title rights and interests and the relationship between the native title rights and interest and other proprietary interests;
(2) the agreement has been procured with the free and informed consent of all parties; and
(3) that the government party has agreed that there is a credible and rational basis for the determination proposed.
Freddie at [18], Agius at [64], Cronin on behalf of the Butchulla People (land & sea claim #2) v State of Queensland [2019] FCA 2082 at [14] (O’Bryan J).
Form and content
30 An order of the Court making a determination of native title must set out the following details (ss 94A and 225 of the NTA):
(1) who the persons, or each group of persons, holding the common or group rights comprising the native title area;
(2) the nature and extent of the native title rights and interests in relation to the determination area;
(3) the nature and extent of any other interests in relation to the determination area; and
(4) the relationship between the rights and interests in paragraphs (2) and (3) above (taking into account the effect of the NTA); and
(5) the extent to which the land or waters in the determination area are not covered by a non-exclusive agricultural lease or a non-exclusive pastoral lease — whether the native title rights and interests confer possession, occupation, use and enjoyment of that land or waters on the native title holders to the exclusion of all others.
31 As the determination made by the Court must include these matters, there must be some probative material against which the Court can assess whether those matters can be stated in a determination: Freddie at [21]; Agius at [68]. The principal source of this material will be the parties’ agreed position put to the Court in the proposed determination, together with joint submissions: Agius at [68]. The Court may satisfy itself of the requirements where the government respondent has satisfied itself that there is a sufficient basis for agreeing to a determination under s 87 of the NTA, with such standard of satisfaction being lower than what would be required in a contested hearing before the Court: King on behalf of the Eringa Native Title Claim Group v South Australia [2011] FCA 1386 at [19] (Keane CJ, when his Honour was on this Court); Watson v Western Australia (No 6) [2014] FCA 545 at [29] (Gilmour J). Whilst the Court may not peruse in detail the entirety of the evidence relied upon by the government respondent, it may nevertheless review the material to satisfy itself that the government respondent has acted in good faith and in a rational manner: KD (deceased) on behalf of the Mirning People v Western Australia [2021] FCA 10 at [32] (Colvin J); Western Bundjalung People v Attorney General of New South Wales [2017] FCA 992 at [21] (Colvin J).
32 Finally, I note that, where as here, there has been some refinement of the description of the native title holders in the period since the application was registered, the Court is not limited to making a determination in the form sought in the Original Application. Provided that the application is valid and in accordance with the law, the Court may proceed to make a determination in such form as it sees fit based on the material available to it: Billy Patch & Others on behalf of the Birriliburu People v State of Western Australia [2008] FCA 944 per French J, when his Honour was on this Court, at [18]; Sharpe v State of Western Australia [2013] FCA 599 at [18] (Gilmour J).
MATERIAL
33 The following material has been provided and considered in reaching the agreement reflected in the Consent Minute. The State has had regard to these materials for the purpose of considering the Nyalpa Pirniku claim group’s connection to, and occupation of, the land and waters of the Determination Area:
(1) Nyalpa Pirniku native title determination application (Form 1) and accompanying affidavits;
(2) Evidence and findings made by the Court in the Wongatha Determination, including a summary of that material compiled by Dr John Morton (the anthropologist for the Nyalpa Pirniku Applicants) entitled “A Guide to Materials from the Wongatha Proceeding” dated 18 January 2021. Relevantly, Dr Morton identified 45 people who gave evidence in the Wongatha Determination and who were members of the present Nyalpa Pirniku claim group;
(3) Evidence and findings in Maduwongga separate question proceeding, including:
(a) The Nyalpa Pirniku Native Title Claim Preliminary Anthropological Report by Dr Morton dated 1 April 2019 (Morton 2019 Report);
(b) Anthropology Report on the Separate Question in Maduwongga by Dr Morton dated April 2020 (Morton Separate Question Report);
(c) witness statements of H.O (deceased) (10 December 2020), E.S. (deceased) (11 December 2020), Cheryl Cotterill (14 December 2020) and Ivan Forrest (14 December 2020); and
(d) the transcript of the hearing;
(4) Additional material demonstrating connection of the Nyalpa Pirniku claim group to the Determination Area provided by the Nyalpa Pirniku Applicants comprising:
(a) “A Guide to the Distribution of Families across the Claim Area” by Dr Morton dated 10 February 2021;
(b) Report on “The Right to Take and Use Resources ‘for Any Purpose’” by Dr Morton dated 23 March 2021;
(c) Report on “The Right of Exclusive Possession” by Dr Morton dated 20 April 2021 (Right of Exclusive Possession Report); and
(d) the Additional Apical Report; and
(5) Witness statements from seven Nyalpa Pirniku claimants (being H.O (deceased), Ivan Forrest, Janice Scott, Quinton Tucker, Eric Thomas, Sarah Sullivan and Dennis Forrest) directed to the requirements of ss 47, 47A and/or 47B of the NTA.
34 The parties also rely on the affidavit of Jeremy Brown, NTSG, solicitor for the Nyalpa Pirniku Applicants, affirmed 22 September 2023, deposing to the decision-making process, establishment of the requisite prescribed body corporate (PBC) and the process of authorisation of the Consent Minute under consideration.
35 Before moving to consider whether it is appropriate to make orders in accordance with, or consistent with, the Consent Minute, I will describe in broad terms the materials relied on in support of this Application to address the following matters: assessment of connection with the Determination; traditional laws and customs of the WDCB and the ongoing connection with the Determination Area.
36 Having reviewed the materials and joint submissions, I am satisfied that the agreement has been entered between the parties freely and on an informed basis. In relation to the State, I am satisfied on the basis of the joint submissions, and the materials on which the submissions are based, that the State has acted in good faith and in a rational manner in taking steps to satisfy itself that there is a credible basis for the Application and that evidence on which the Nyalpa Pirniku Applicants rely is cogent.
ASSESSMENT OF CONNECTION
Nyalpa Pirniku Applicants and their country
37 As mentioned above, this Application is brought on behalf of members of the WDCB, the Nyalpa Pirniku claimants being a subset of Western Desert people who hold the native title rights and interests under WDCB traditional laws and customs in the Determination Area. The Determination Area is within the boundaries of the WDCB, as found in the Wongatha Determination. Similarly, in Strickland, the Court found that at sovereignty the Aboriginal people in occupation of the Maduwongga Overlap Area (that is, the western portion of the Determination Area) observed the laws and customs of the WDCB.
Connection to, and obtaining rights in, country
38 The claim group description reflects the “multiple pathways” by which people may acquire rights and interests in land in the WDCB and the people who, according to those pathways, have rights and interests in the Determination Area.
39 The suite of “multiple pathways” by which people may acquire rights and interests in land in the WDCB is well-established. Under the “multiple pathways” model, the association of individuals and groups with particular areas of country comes about through a variety of mechanisms including: birth in, or long association with, a place; descent from someone connected to that place at effective sovereignty or the early 20th century; death or burial of a close relative at a place; knowledge or authority in relation to tjukurrpa applicable to a place; and/or ceremonial responsibility for a place.
40 The Morton 2019 Report provides details of the families and individuals who comprise the Nyalpa Pirniku claim group and their “multiple pathways” to connection to the Determination Area. Relevantly, a number of the Nyalpa Pirniku apical ancestors were born c.1890 (or earlier) and were resident in the Determination Area in the first decades of the twentieth century, some having migrated from further east of the Determination Area (in the “spinifex”) to Laverton, Burtville and Mt Margaret during this period. Their descendants have similarly resided in, and been associated with, the Determination Area.
41 It is useful to reproduce a portion of the decision of the delegate of the Native Title Registrar on the application for registration of the Application (dated 10 December 2021, NNTT no. WC2019/002):
[63] The [Morton 2019 Report] provides that, prior to British sovereignty, the predecessors of the claim group were spiritually connected to the application area through the tjukurrpa and held rights in the application area pursuant to the laws and customs of the WDCB society, of which they were members. European settlement in the region of the application area did not occur until the gold rush in the 1890s. The apical ancestors of the claim group were associated with the application area when European settlement occurred, for example:
(a) Tjanun Shannon was born around 1885 and his grandchildren remember him regularly walking a circuit through the application area, including through the Laverton area and Burtville in the north east;
(b) Eva Trilby and Polly (mother of Norman John Forrest) were both born around 1880 and lived on Korong station just outside the northern boundary of the application area, where they both gave birth to and raised their children;
(c) Nganpurn Lily Sullivan (nee Bird) is associated with the southern part of the application area – she was born at Edjudina in about 1898 and lived with her mother and three children near Lake Rebecca;
(d) Micky and Nyurbanu were born around 1865 and were described by their son Yordy as associated with places throughout the application area including Burtville and Edjudina, through to Laverton in the north, and Leonora and Menzies near the western boundary; and
(e) Tjinabanmang Ginger Stokes was born around 1868 near Lake Minigwal near the eastern boundary of the application area and his sister Alma was born further east towards Warburton.
[64] [The Morton 2019 Report] also provides information about the intervening generations of the claim group and their association with the application area, including, for example:
(a) The son of apical ancestor Ngadju Maggie was born about 1905 near Burtville and he and his descendants are associated with that area and west to Mt Margaret;
(b) The grandson of apical ancestor Eva Trilby was born at Kookynie around 1918 and showed his country to his son (now a senior claim group member), which extends from Koyong to Mt Margaret and south to Edjudina and Pinjin; and
(c) The son of Talku Mary Ann was born in the early 1900s and was a lawman for the area around Laverton who taught current claimants about tjukurrpa sites in the application area.
[65] Examples are also provided of the association between current claim group members and the application area, including:
(a) The great-grandson of apical ancestors Tjanun Shannon and Ngadju Maggie was born at Mt Margaret in 1936 and grew up there, later living at Menzies, Laverton and Leonora;
(b) The descendants of Ningu recall being taken by their parents to camp around Edjudina and taught how to survive in the bush, and they continue to visit the area to maintain the rockholes there;
(c) One of the descendants of Ngajuji Davey Johnson was born at Dingo Creek in the application area and was taught the dreaming sites and stories for the area, where he regularly camps with his cousins and checks and cleans the rockholes.
42 Given that the date of effective sovereignty in the area is approximately 1890, the parties jointly submit that it is possible to draw an inference that members of the WDCB (and the Nyalpa Pirniku claim group in particular) have been in occupation of the Determination Area since prior to the date of effective sovereignty. I agree that such an inference is available. I have taken that into account as part of my assessment of the probative basis on which the State has relied to reach the requisite satisfaction in relation to the Application.
Traditional Laws and Customs
43 The “multiple pathways” model of the WDCB is closely connected to the tjukurrpa, sometimes translated as “The Dreaming”, a foundational belief of WDCB people and the Nyalpa Pirniku claim group. The tjukurrpa is addressed in the materials available to the parties on this Application, including the Morton 2019 Report; the Right of Exclusive Possession Report, the expert conference report in the Maduwongga Separate Question and the Maduwongga Separate Question Transcript, as well as in decisions of the Court: Murray on behalf of the Yilka Native Title Claimants v State of Western Australia (No.5) [2016] FCA 752 at [195] (McKerracher J) and Wongatha Determination at [688].
44 The tjukurrpa is a time when mythical creation beings (also termed tjukurrpa) acted and interacted on the earth. Tjukurrpa stories recount the travels of these creation beings across the landscape and their activities. These beings sometimes left traces of their presence in the landscape as they travelled across it, creating particular sites and features. For example, in 1959 Professor Ronald Berndt, anthropologist, identified 11 main tjukurrpa tracks that criss-crossed the Western Desert, mostly, though not invariably, following the known permanent and impermanent waterhole routes. Some tjukurrpa stories, such as the wati kutjera (Two Men) and Seven Sisters stories, extend beyond the WDCB.
45 Tjukurrpa informs and provides the basis for, and is the source of, WDCB laws and customs (the ‘Law’). The creation beings not only created the landscape — they were also the first to practice all laws and customs. The tjukurrpa is therefore a code to be followed. Tjukurrpa are ‘held’ by senior men (wati) and senior women who are appropriately inducted into the story, its ritual and its objects. Knowledge of tjukurrpa is distributed through a regional community of wati who come together for ceremonies. Smaller areas of country are thus integrated into a regional system and are not wholly independent of each other. As described by Dr Morton, the tjukurrpa can be understood as follows:
… The Dreaming is the ground of reality in the sense that things emerge from it into ‘reality’, ready to be seen; The Dreaming makes things ‘appear’. As Myers describes it, in line with everything described about thukurrpa by earlier writers such as Elkin and Berndt (see earlier in this report), The Dreaming now manifests itself by tracks and landscape features that were created (‘made visible’) by ‘mythological personages’ known as ‘totemic ancestors’. Moreover, things – not least of all people – continue to materialise this way from The Dreaming, since ‘conception and birth’ are ‘the emergence of an individual from the plane of The Dreaming onto the physical, phenomenal plane of existence’.
Further than that, The Dreaming is a ‘theory of everything’, since it ‘underlies every feature of [the] universe’, including what is known in Aboriginal English as ‘The Law’. One comprehensive Western Desert dictionary glosses ‘tjukurpa’ as both ‘Dreaming’ and ‘Law’, although its primary meaning appears as ‘story’ (which covers mythology as well as ‘unimportant stories’), and a tertiary meaning appears as ‘word’. The Dreaming, therefore, is a kind of story that Western Desert people tell themselves about themselves and their world, and notion of ‘Law’ emphasises the normative dimensions of such stories. Ancestral beings did not only guarantee the ‘reality’ of places, since they were also the first to practice[sic] all laws and customs within a specified legal and moral framework. The Dreaming as a whole is therefore also a code to be followed; as an inheritance, people follow their ancestors, who are The Dreaming. This ancestral ‘ascent’ was, in my opinion, the essence of local tradition in and about the NPC area.
46 The parties submit, that the tjukurrpa remains front and centre in the world of the contemporary Nyalpa Pirniku claim group, being both the foundation and the source of the traditional laws and customs of the WDCB — it determines how WDCB members, including those of the Nyalpa Pirniku claim group, interact with and relate to their country. The importance of the tjukurrpa, or thukurr, to Nyalpa Pirniku claimants is summarised in the Morton 2019 Report as follows:
During the recent research, I have not heard a single person deny the fundamental importance of thukurr. While some are more closely involved than others in the articulation of duties to the Law, acknowledgement of ancestral presence on country appears to be universal, in terms of both The Dreaming’s physical manifestations (‘sites’) and its spiritual powers. According to…a recently deceased senior wati, the thukurr contain ‘our DNA’
47 The Determination Area is defined by a number of tjukurrpa and other sites which are “held under varying degrees of restriction and control”. Relevantly, Dr Morton identified 18 tjukurrpa sites relevant to the Determination Area and stated he had witnessed sites within the Determination Area associated with 11 of the 18 tjukurrpa. Further, in Strickland, the Court recorded a number of tjukurrpa known to members of the Nyalpa Pirniku claim group within the Determination Area, including the wati kutjarra and warnampi (serpent) dreaming: Strickland at [631] – [638]. Some other places of significance to the Nyalpa Pirniku claim group within the Determination Area were also recorded in Strickland, including gender restricted sites, rock holes and cave paintings: Strickland at [650] – [652].
48 The Nyalpa Pirniku claim group have a responsibility to look after these tjukurrpa and other important places and “make sure that [they] are protected; that the stories [about them] are told; and that the sites themselves are looked after.” The Nyalpa Pirniku claim group still believe in the power of tjukurrpa and other spirits of the country to punish trespassers and “the need to be alert for the presence of [spiritual beings] as part of a suite of strategies to keep safe on country”. They thus have formal protocols that must be followed when approaching certain places or things and actively check on sites to ensure that they have not been damaged.
49 By way of final example, the parties submit that members of the Nyalpa Pirniku claim group also continue to maintain certain “increase sites” in the Determination Area and have an “ongoing ability to undertake ‘increase’ rites to breed up emu, red kangaroo and witchetty grubs” at those sites. Dr Morton also notes that sacred objects used in Law business are stored on the Determination Area and protected by the Nyalpa Pirniku claim group. Further that the Nyalpa Pirniku claim group also undertake activities in the nature of caring for country, such as cleaning rock holes.
Ongoing Connection to the Determination Area
50 The parties submit that the Nyalpa Pirniku claimants have maintained their connection to the Determination Area since c.1890. The parties submit that the Nyalpa Pirniku claim group maintain their connection to the land and waters in the Determination Area through:
(1) continuing to camp, fish, hunt and gather on their country on weekends and during holidays;
(2) accessing country and using the time on country to transmit cultural knowledge from their parents, grandparents and other relatives, both through stories and through example;
(3) being shown the country, what to do on it, and how to behave at certain places in order to show respect to the spiritual forces and thus remain safe on, and protect, the country;
(4) continuing to have knowledge of a large number of significant places in the Determination Area of religious, economic, social and historical importance including familiarity with their country and the customs and practices relating to the procuring of food, water, medicine and other materials; and
(5) hunting native game and collecting numerous edible or otherwise useful plants with the knowledge of how to find, get, prepare and use the natural resources of the country having been passed down through generations.
51 The parties also draw attention to the detailed description of the current connections of some contemporary Nyalpa Pirniku claim group members outlined in Strickland.
CONSIDERATION
52 For the reasons which follow, I find that the Court may make orders in accordance with the terms of the proposed consent determination, pursuant to ss 87(1A) and (2) of the NTA.
53 As a preliminary matter, I am satisfied that the Nyalpa Pirniku Applicants are authorised to bring this Application pursuant to s 61(1) of the NTA. Under, the NTA they jointly have the carriage of this application and pursuant to s 62A of the NTA are authorised to deal with all matters arising under the NTA in relation to this application, including entering into an agreement under s 87 of the NTA.
54 The Nyalpa Pirniku claim group met at Kalgoorlie on 19 September 2023. At that meeting they were informed of the proposed consent determination as reflected in the Consent Minute and confirmed the authorisation of the Applicants to consent to the Court making a determination in, or consistent with, the terms of the Consent Minute. They also authorised NTSG and the Applicants to do all things necessary to finalise the Determination.
55 I am satisfied that the Applicants are authorised to consent to the Court making a determination in, or consistent with, the terms of the Consent Minute.
56 The parties submit, and I accept that the agreement of the parties recorded in the s 87 agreement has been freely entered into on an informed basis. Further, that there is a credible basis for the proposed orders based on cogent evidence.
57 The Nyalpa Pirniku Applicants and the State are legally represented and have been at all material times during the course of the negotiations that culminated in the consent minute. All other parties have either obtained independent legal advice or had the opportunity to do so.
58 I am satisfied that each of the following requirements under s 87 of the NTA has been met:
(1) the period specified in the notice given under section 66 of the NTA has ended (s 87(1));
(2) there is an agreement for a proposed determination of native title in relation to the proceeding (s 87(1)(a));
(3) the terms of the proposed determination, in writing signed by or on behalf of all of the parties, has been filed with the Court in the form of the Consent Minute (ss 87(1)(aa),(b)); and
(4) the Court is satisfied that an order in, or consistent with, the Consent Minute would be within the power of the Court (section 87(1)(c)).
59 In relation to the Consent Minute, and for the avoidance of doubt, I note that since finalisation of the Consent Minute and it being provided to the parties for signature, a number of parties have ceased to be respondents to the proceeding. For that reason, the Consent Minute contains signature blocks (but no signatures) for Gibb River Diamonds Ltd, Kaili Gold Pty Ltd, Paul Crisp, Robert Donald Marsh and Menangina Pty Ltd. I am satisfied that these parties were not, at the time of the Consent Minute was filed, respondents to the proceeding.
60 The parties jointly submit, and I accept, that there is no reason why the Court should not be satisfied that an order consistent with the terms of the Consent Minute is within the power of the Court. First, the Application is valid. Secondly, the Consent Minute provides for a determination of native title in relation to an area for which there is no approved determination of native title (s 13(1)(a) of the NTA) and there remains no approved determination in relation to the area the subject of the proposed determination (s 68 of the NTA). Thirdly, there are no other extant proceedings before the Court relating to native title determination applications that cover any part of the area the subject of the proposed determination which would otherwise require orders to be made under section 67(1) of the NTA. Fourthly, the form of the proposed determination complies with ss 94A and 225 of the NTA and is otherwise consistent with the Court's findings in Strickland. Finally, as noted above I am satisfied that the requirements of s 87 of the NTA are met.
61 The issue then is whether, applying the principles identified above, it is appropriate to make orders in accordance with, or consistent with, the proposed determination embodied in the Consent Minute: s 87(1A) NTA. For the reasons which follow, I am satisfied that it is appropriate to do so.
62 The State has played an active role in the negotiation of the proposed consent determination and ensuring that the Consent Minute otherwise complies with the requirements of the NTA. In doing so, the State, acting on behalf of the community generally and having regard to the requirements of the NTA, has satisfied itself that the determination is justified in all the circumstances.
63 As noted above, in this proceeding there is a large body of evidence in relation to the Nyalpa Pirniku claim group’s connection to, and occupation of, the land and waters of the Determination Area. The Court’s consideration of, and findings in relation to, the evidentiary material is recorded in a publicly accessible form in the Court’s decision in Strickland. The proposed consent determination reflects those findings and is informed by the parties’ acceptance of those findings. In addition, the evidence given by some of the Nyalpa Pirniku Applicants in the Wongatha Determination proceeding is relevant to, and also provides support for, the proposed consent determination.
64 Some matters covered by the proposed consent determination were not the subject of specific findings of the Court in Strickland. Those matters have been subsequently agreed in mediation. The State considers that the connection material provided by the Applicants is sufficient to demonstrate that in respect of the Determination Area, the Application has a “credible or cogent basis”. Further, that members of the Nyalpa Pirniku claim group are each respectively bound together by a normative system of laws and customs which, on the basis of known fact and reasonable inference, has continued to be observed by its members in a substantially uninterrupted manner since prior to the declaration of sovereignty over Western Australia. The parties jointly submit that members of the Nyalpa Pirniku claim group have maintained a physical presence in their respective part of the Determination Area since the acquisition of British sovereignty and have a continuing physical or spiritual involvement in that area. On the whole of the materials available to it, the State is satisfied that the material presented is sufficient to evidence the maintenance of connection according to relevant traditional laws and customs in the Determination Area. The State has concluded that this connection has not been severed. The material, and the agreement of the parties, supports that conclusion.
65 The State has also conducted searches of land tenure, mining and petroleum registries to determine the nature and extent of “other interests” within the Determination Area, and those interests have been included in the proposed determination: Consent Minute, Schedule 6. In this way, the description of the nature and extent of the native title rights and interests and the “other interests” in relation to the Determination Area complies with s 225 of the NTA.
66 All respondents have been consulted and given opportunities to participate in the process as it has progressed. All extant respondents, who are still parties to the proceeding as at 26 September 2023, have signed the Consent Minute indicating that they consent to the proposed determination.
NOMINATION OF THE PBC
67 Being satisfied that it is appropriate to make a determination of native title, s 55 requires that the Court must make the determination provided for in ss 56 and 57. Section 56 requires a determination of whether the native title is to be held in trust and, if so, by whom. Section 57 specifies the authorised functions of a PBC in particular circumstances.
68 The Consent Minute (at order 2) provides for the nomination of the Wangkatja Tjungula Aboriginal Corporation (ICN 9951) (WTAC) to hold the native title in the Determination Area as agent for the native title holders.
69 The Nyalpa Pirniku claim group agreed to incorporate WTAC at a meeting in Kalgoorlie on 15 March 2023. At that meeting, the claim group also nominated WTAC to be the PBC for the Nyalpa Pirniku common law holders of native title. WTAC accepted the nomination to act as the PBC at a pre-incorporation general meeting, also held in Kalgoorlie on 15 March 2023. The corporation documents were lodged with the Office of the Registrar of Indigenous Corporations for registration on 1 May 2023 and WTAC was registered on 3 May 2023. I will order that WTAC shall hold the determined native titled as agent for the native title holders pursuant to s 57(2) of the NTA.
CONCLUSION
70 For these reasons, I conclude that the Court has the power to make the orders sought granting native title. I also consider it appropriate that the orders be made. I make orders, substantially in the form advanced by agreement in the Consent Minute. I congratulate the parties and their advisers.
