In the Judgment of the Honourable Justice Jacobson delivered on 4 May 2004 make the following amendment:

The orders on the second cover page should be replaced with the following:

1.      The motion for extension of time be refused.

2.      The applicant to pay the respondent's costs of the motion in the agreed amount of $200.

The second sentence of paragraph 8 should be replaced with the following:

I order the applicant to pay the respondent's costs in the motion in the agreed amount of $200.
